Every person who sells commercial fertilizer in or for importation into this state for use therein, who is licensed under Section 2-22-5 or where such person is required to procure such a license shall file with the commissioner on forms furnished by the commissioner a monthly statement for the period ending on the last day of each month setting forth thereon the number of tons of each grade of commercial fertilizer sold in or for importation into this state for use therein during such month. The person shall also include on the report any information of the type provided by Section 2-22-10 when required to do so pursuant to rules and regulations promulgated by the commissioner with approval of the board. Any licensee not estimating annual tonnage shall file the following information on a quarterly statement provided by the Department no later than the last day of January, April, July, and October of each year for the preceding calendar quarter and pay the inspection fees and any penalties, if applicable: a.If the inspection fee is being passed on to the purchaser: b.The assigned number and name of the currently licensed company; The commercial fertilizer by code or grade;The amount of commercial fertilizer in whole tons; The name, title, telephone number, and signature of the licensee or the licensee’s authorized representative; and The date of the report. Arkansas Tonnage Reporting – Who is responsible?

All manufacturers and manipulators or agents representing them who have registered their brands in compliance with Section 1 of this Act shall forward to the State Plant Board each month a report which shall reach its office on or before the twentieth day of the month, on the forms and in the number of copies to be prescribed by the Plant Board. The report shall include a sworn statement of the total tonnage of all commercial fertilizers and fertilizer materials shipped or caused to be shipped, for sale or consumption in this State, or which have been made, mixed, manufactured or compounded in this State for sale or consumption in this State. California Tonnage Reporting – Who is responsible?

Licensees are required to report, semi-annually, the tonnage of commercial fertilizers, specialty fertilizers, agricultural minerals, and/or compost sold/distributed in California, as defined in the Food and Agricultural Code, Sections 14512, 14522 and 14563, 14550.5, and 14525. Colorado Tonnage Reporting – Who is responsible?

Registrants, except those who package fertilizers in containers of 10 pounds or less, must report and pay a distribution fee of $1.10/ton for all commercial fertilizers that are distributed in the State of Colorado. Registrants of specialty fertilizers or small packages in containers of 10 pounds or less must pay a tonnage fee of $.01025/pound. If more than one firm is involved in distribution, the last registrant must report and pay the fees, unless a prior distributor does so. The last registrant is the firm whose name appears on the label and registration application for the product in question. Illinois Tonnage Reporting – Who is responsible?

Every entity that distributes a fertilizer, custom blend, or speciality fertilizer in this State shall file with the Director, on forms furnished by the Director, a semi-annual statement for the periods ending June 30 and December 31, setting forth the number of net tons of each grade of fertilizers within a brand or the net tons of custom blend distributed. When more than one entity is involved in the distribution of a fertilizer, the last registrant who distributes to the consumer or end user is responsible for reporting the tonnage and paying the inspection fee. Indiana Tonnage Reporting – Who is responsible?

Except as provided in subsection (c), a person who distributes commercial fertilizers: (1) in bulk; or (2) in packages weighing more than twelve (12) pounds; in Indiana to a person who is not a registrant or permit holder under this chapter shall pay to the state chemist an inspection fee computed under subsection (b). (b) The inspection fee charged under subsection (a) is forty-five cents ($0.45) per ton for each ton of commercial fertilizer distributed. If a fertilizer tonnage report is required under this chapter, the minimum inspection fee is ten dollars ($10) payable semiannually. Iowa Tonnage Reporting – Who is responsible?

There shall be paid by the licensee to the secretary for all commercial fertilizers and soil conditioners sold, or distributed in this state, an inspection fee to be fixed annually by the secretary of agriculture at not more than twenty cents per ton. Sales for manufacturing purposes only are hereby exempted from fees but must still be reported showing manufacturer who purchased same. Kansas Tonnage Reporting – Who is responsible?

Each person registering any commercial fertilizer shall file an affidavit semiannually, with the secretary, within 30 days after each January 1 and each July 1, showing the tonnage of commercial fertilizer sold or distributed in Kansas for the preceding six-month period. Each such registrant shall pay to the secretary the inspection fee due for such six-month period, except that the registrant shall not be required to pay the inspection fee or report the tonnage of commercial fertilizers or fertilizer materials sold and shipped directly to fertilizer manufacturers or mixers. Kentucky Tonnage Reporting – Who is responsible?

An inspection fee of $0.50 per ton shall be paid only once on each ton of fertilizer sold in the state and the last registrant/licensee selling to a non-registrant/non-licensee (dealer) shall be responsible for reporting the tonnage and paying the inspection fee unless the report and payment is made by a prior registrant/licensee; however, any seller of the fertilizer may be required to pay the fee in the event it has not been collected. The following is a true report of all Fertilizer distributed by this firm in the State of Maryland as required by the Maryland Commercial Fertilizer Law. Each licensee who distributes a soil amendment or commercial fertilizer, except specialty fertilizer and unmanipulated animal or vegetable manures, to an unlicensed person in this state shall file with the department on forms approved by the department a semiannual tonnage statement for the reporting periods ending June 30 and December 31. Each in-state manufacturer and out-of-state supplier who distributes a soil amendment or commercial fertilizer in this state to a person regardless of license status, except specialty fertilizer and unmanipulated animal or vegetable manures, shall file with the department on forms approved by the department an inspection fee statement for each of the reporting periods ending June 30 and December 31. Nebraska Tonnage Reporting – Who is responsible?

There shall be paid to the director, for all commercial fertilizers and soil conditioners distributed in this state to the ultimate user, except custom-blended products, an inspection fee at the rate fixed by the director but not exceeding fifteen cents per ton. The fee shall be paid by the person distributing the product to the ultimate user.Every person who distributes commercial fertilizer or soil conditioners to the ultimate user in this state shall file, not later than the last day of January and July of each year, a semiannual tonnage report on forms provided by the department setting forth the number of net tons of commercial fertilizer and soil conditioners distributed in this state during the preceding six-month period, which report shall cover the periods from July 1 to December 31 and January 1 to June 30, and such other information as the director shall deem necessary. New Mexico Tonnage Reporting – Who is responsible?

Tonnage reporting applies to all registrants and or distributors of commercial fertilizer and soil conditioners, sold or distributed, into or within the state of New Mexico and applies to all products, packaged or bulk, distributed in quantities of five pounds or greater. Each manufacturer, importer, jobber, firm, corporation or person who distributes commercial fertilizers in this State shall make application to the Commissioner for a permit to report the tonnage of commercial fertilizer sold and shall pay to the North Carolina Department of Agriculture and Consumer Services an inspection fee of fifty cents (50¢) per ton.Each registrant shall report monthly the tonnage sold to non-registrants on forms furnished by the Commissioner. North Dakota Tonnage Reporting – Who is responsible?

On or before January thirty-first, each licensed person who distributes a fertilizer, fertilizer material, micronutrient, specialty fertilizer, soil amendment, or plant amendment in this state shall: (1) File with the commissioner a form stating the number of net tons [kilograms] of each listed product distributed in this state during the preceding calendar year; and (2) Submit to the commissioner the inspection fee required by this section. Ohio Tonnage Reporting – Who is responsible?

A licensee or registrant shall pay the director of agriculture an inspection fee of twenty-five cents per ton for all of the following, as applicable:
(1) All fertilizer that the licensee distributes in this state to a person that has not been issued a license under section 905.32 of the Revised Code;
(2) All fertilizer that the licensee applies in this state for purposes of agricultural production and all fertilizer that is applied in this state on behalf of the licensee by an employee or contractor who is certified under section 905.321 of the Revised Code;
(3) All fertilizer that the registrant distributes in this state.
However, the inspection fee does not apply to packaged fertilizers that are in containers of ten pounds or less.

Oklahoma Tonnage Reporting – Who is responsible?

Each registrant distributing fertilizer in this state shall file with the State Board of Agriculture, not later than the last day of January and July of each year, a semiannual inspection fee report setting forth, under oath, the number of tons sold or distributed during the period and pay an inspection fee of One Dollar ($1.00) per ton of which fifty cents ($0.50) per ton shall be forwarded directly to a special Soil Fertility Research Account in the Department of Plant and Soil Sciences of the Division of Agricultural Sciences and Natural Resources at Oklahoma State University for the purpose of conducting soil fertility research and extension involving efficient fertilizer use for agronomic crops and forages and groundwater and surface water protection from plant food nutrients. Sales or exchanges between importers, manufacturers, distributors, registrants, or licensees are exempt. A person shall file a semiannual tonnage report with the State Department of Agriculture if the person: a) Distributes into this state, from foreign or domestic sources, a fertilizer, agricultural amendment, agricultural mineral or lime product used as an ingredient in the in-state manufacture of a fertilizer, agricultural amendment, agricultural mineral or lime product; b) Distributes into this state, from foreign or domestic sources, an end-use fertilizer, agricultural amendment, agricultural mineral or lime product for use within this state; or c) Distributes into this state a fertilizer, agricultural amendment, agricultural mineral or lime product composed of ingredients not described under paragraph (a) or (b) of this subsection. Pennsylvania Tonnage Reporting – Who is responsible?

Requirements.--The guarantor whose name appears on a label shall submit, along with the requisite inspection fee, a report in a manner prescribed by the department listing by county the intended use and net tons of each brand and grade of fertilizer distributed in this Commonwealth for the period covered by the inspection fee. If more than one person is involved in the distribution of a commercial fertilizer, the distributor who imports, manufactures, or produces the commercial fertilizer is responsible for the inspection fee on products produced or brought into this state. Washington Tonnage Reporting – Who is responsible?

All licensees and registrants are required to report tonnage, regardless of the amount of fertilizer/lime distributed or whether inspection fees are owed. This report must be filed regardless of the amount distributed. If you distribute less than 100 tons in a 6 month period you can report annually by filling out the forms 4330 series. There shall be paid to the department for all commercial fertilizers distributed in this state to non-registrants or non-licensees an inspection fee of twenty cents per ton of lime and thirty-five cents per ton of all other commercial fertilizer distributed during the year beginning July 1st and ending June 30th. Distribution of commercial fertilizers for shipment to points outside this state may be excluded. The person transacting, distributing or selling fertilizer to a nonregistrant shall furnish the commissioner a report showing the county of the consignee, the amounts (tons) of each grade of fertilizer, and the form in which the fertilizer was distributed (bags, bulk, liquid, etc.).  When more than one person is involved in the distribution of a fertilizer, the last person who has the fertilizer registered or distributes to a nonregistrant (dealer or consumer) is responsible for reporting the tonnage and paying the inspection fee, unless the report and payment is made by a prior distributor of a fertilizer. That sales to manufacturers or exchanges between them are hereby exempted. West Virginia Code | §19-15-5

ANNUAL TONNAGE REPORT AND FEE PAYMENT. By September 30 of each year, a person required to hold a fertilizer license under s. ATCP 40.04 shall do all of the following: (a) Report to the department the number of tons of each grade of fertilizer that the person distributed in this state in the 12 months ending June 30 of that year.  FEE EXEMPTIONS.
