Fertilizers

1. Product Registration and Compliance - Fertilizers must be registered in each U.S. state where they will be sold or distributed. Each state has its own registration requirements and processes.

2. Labeling Requirements - Fertilizer labels must accurately reflect the product's contents, including nutrient analysis, application instructions, and any safety warnings. Labels should comply with both federal and state regulations.

3. Customs and Border Protection (CBP): Importers must file appropriate entry documentation with CBP, including details about the product, its origin, and compliance with U.S. regulations.

 

Soil Amendment Import Regulations

1. APHIS Oversight

  • The U.S. Department of Agriculture's Animal and Plant Health Inspection Service (APHIS) regulates the importation of soil amendments, especially those containing organic materials or living organisms.
  • Importers may need to obtain permits or other documentation from APHIS, particularly if the soil amendments contain living microorganisms or plant materials.

2. Environmental Assessments

  • APHIS evaluates the potential environmental impact of imported soil amendments. If a product is authorized to enter the U.S., certificates of purity and identity may be required.

 

General Requirements for Importing Samples for Lab Testing

1. Documentation and Declaration

  • Cover Letter or Declaration: Include a statement with the shipment indicating:
    • The sample is intended solely for laboratory analysis.
    • It will not be sold, distributed, or used in field applications.
    • Details of the receiving laboratory (name and address).
    • Description of the sample, including its composition and intended analysis.
  • Safety Data Sheet (SDS)
  • Labeling

2. Import Permits

  • APHIS Permits: If the sample contains plant materials, soil, or living organisms (e.g., microbes), an import permit from APHIS may be required. This is to prevent the introduction of pests or diseases into the U.S.
  • EPA Regulations: For samples containing pesticides or substances regulated under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), compliance with EPA regulations is necessary. This includes submitting a Notice of Arrival (EPA Form 3540-1) to both the EPA and CBP.
